Terms of Service

Welcome to Inkspot Tattoo Market ("Inkspot", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Inkspot platform, including our website, mobile applications, and all related services (collectively, the "Platform").

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform. You must be at least 18 years of age to create an account or use our services, as tattooing is an age-restricted activity.

Registration: You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Account Types: Inkspot offers two primary account types — Client accounts for browsing and booking tattoo services, and Artist accounts for listing flash designs and managing bookings. Artists must complete verification and onboarding before listing services.

Account Security: Notify us immediately if you suspect unauthorised access to your account. We are not liable for losses resulting from unauthorised use of your credentials.

Termination: We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period. You may delete your account at any time by contacting support.

Inkspot is a marketplace connecting tattoo artists with clients. We facilitate discovery, booking, and payment but do not perform tattoo services directly.

Artists agree to:

• Upload only original work or work they have the right to list
• Provide accurate descriptions of their designs, pricing, and availability
• Maintain appropriate hygiene and safety standards
• Respond to booking requests in a timely manner
• Comply with all applicable local licensing and health regulations

Clients agree to:

• Provide accurate information during the booking process
• Honour confirmed bookings or follow the cancellation policy
• Not reproduce, redistribute, or claim ownership of artist designs
• Treat artists and other users with respect

Prohibited Content: Content that is offensive, discriminatory, infringing on third-party rights, or illegal is strictly prohibited and may result in account suspension.

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service in addition to these Terms.

Pricing: Artists set their own prices. Inkspot charges a 10% platform fee on top of the artist's listed price, paid by the buyer. Stripe processing fees (2.9% + $0.30) are also paid by the buyer.

Deposits: Bookings require a 50% deposit at the time of booking. The remaining balance is due before or at the time of the appointment.

Artist Payouts: Artists receive 100% of their listed price. Payouts are processed according to the artist's payout schedule and preferences configured in their studio settings.

Taxes: Artists are responsible for reporting and paying any applicable taxes on their earnings. Inkspot does not withhold taxes on behalf of artists.

• 7+ days before appointment: 75% refund of deposit
• 3-6 days before appointment: 50% refund of deposit
• Less than 3 days: No refund
• Artist-initiated cancellations: Full refund

Refunds are processed back to the original payment method within 5-10 business days.

Artist Designs: Artists retain full copyright ownership of their designs. By listing on Inkspot, artists grant us a non-exclusive, worldwide licence to display their designs on the Platform for the purpose of facilitating sales and bookings.

Client Rights: Purchasing a tattoo design grants the client a personal licence to have that design tattooed on their body. It does not transfer copyright or grant rights to reproduce, resell, or redistribute the design.

Platform Content: All Inkspot branding, logos, and platform content are owned by Inkspot and may not be used without written permission.

Inkspot acts as a marketplace facilitator. We do not perform tattoo services and are not responsible for the quality, safety, or outcome of any tattoo performed by artists on the Platform.

To the maximum extent permitted by law, Inkspot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claim arising from or related to the Platform shall not exceed the amount you paid to Inkspot in the 12 months preceding the claim.

If you have a dispute with another user, we encourage you to first attempt to resolve it directly. If that is not possible, you may contact our support team through the Help Center to request mediation.

For disputes between you and Inkspot, we will attempt to resolve them amicably. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts as specified in the Governing Law section below.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.

By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

We may update these Terms from time to time. When we make material changes, we will notify you via email or through a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

We encourage you to review these Terms periodically. The "Last updated" date at the top indicates when the most recent changes were made.

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national law of the jurisdiction in which Inkspot operates. Nothing in these Terms shall affect your statutory rights as a consumer under applicable EU or national law.
